Description of Service
ElevatePlay AI is an AI-powered search and discovery platform that helps parents and guardians find youth sports programs in San Diego County, California. The Service uses artificial intelligence to search publicly available information and generate personalized program recommendations based on criteria you provide (sport, age, competitiveness level, and zip code).
The Service currently operates in beta, serving San Diego County only. We are actively expanding to additional markets.
The Service includes:
- A 4-step search wizard to capture your child's sports preferences
- A free preview of one AI-generated program recommendation
- A paid unlock option ($2.99) to view all 8 personalized recommendations
- Program details including ratings, reviews, distance, cost, and season information
- Tools to compare, save, and share program results
Eligibility
You must be at least 18 years of age to use ElevatePlay AI and make purchases through the Service. By using the Service, you represent and warrant that you are 18 years of age or older.
The Service is intended for parents, guardians, and legal representatives searching for youth sports programs for children in their care. Use of the Service for any other purpose is not permitted without prior written consent from ElevatePlay AI.
Payment Terms & Refund Policy
Pricing: Access to the full set of 8 program recommendations requires a one-time payment of $2.99 USD per search. This is not a subscription — you pay only when you choose to unlock a specific search result.
Payment processing: All payments are processed securely by Stripe, Inc. By providing payment information, you authorize us to charge the stated amount to your payment method. We do not store your credit card details.
Taxes: Prices are listed in USD. You are responsible for any applicable taxes in your jurisdiction.
Chargebacks: If you initiate a chargeback with your bank without first contacting us for a refund, we reserve the right to dispute the chargeback and may restrict your access to the Service.
Accuracy of Program Information
ElevatePlay AI uses artificial intelligence and web search technology to locate and compile information about youth sports programs. While we strive to provide accurate, current, and relevant results, we cannot guarantee the completeness or accuracy of the information presented.
Specifically, we do not guarantee that:
- Programs listed are currently accepting registrations
- Program details (cost, schedule, age ranges) are up to date
- All programs in your area are included in results
- Ratings and reviews reflect current program quality
- Match scores accurately predict your child's experience
If you discover inaccurate information about a program, please report it to support@elevateplay.ai and we will investigate and correct it promptly.
Acceptable Use
You agree to use ElevatePlay AI only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any purpose other than finding youth sports programs for children in your care
- Attempt to circumvent the payment system or access paid content without paying
- Use automated tools, bots, or scrapers to access or extract data from the Service
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Submit false, misleading, or fraudulent information during the search process
- Use the Service in a way that could damage, disable, overburden, or impair our servers or systems
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Violate any applicable local, state, national, or international law or regulation
We reserve the right to terminate or restrict access to the Service for any user who violates these acceptable use requirements.
Intellectual Property
The Service, including its design, text, graphics, logos, and underlying technology, is owned by ElevatePlay AI and protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose (finding youth sports programs) during your use of the platform. This license does not include the right to:
- Reproduce, distribute, or publicly display any content from the Service
- Create derivative works based on the Service or its content
- Use our trademarks, logos, or brand assets without written permission
- Resell, sublicense, or commercially exploit search results
Search results generated by ElevatePlay AI are for your personal use only in evaluating sports programs for your child. They may not be republished, resold, or distributed.
Disclaimers & Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Results obtained through the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements or expectations
ElevatePlay AI is a discovery and recommendation tool, not an endorsement of any specific program, organization, or coach. We are not responsible for your experiences with any program you find through our Service.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELEVATEPLAY AI AND ITS OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE 30 DAYS PRECEDING THE CLAIM — WHICH IN MOST CASES WILL BE $2.99.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless ElevatePlay AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be addressed through good-faith negotiation between the parties. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in San Diego County, California, under the rules of the American Arbitration Association.
Class action waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this section shall prevent either party from seeking emergency injunctive relief in a court of competent jurisdiction.
Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For significant changes, we may also notify registered users by email.
Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree with the new Terms, you must stop using the Service.
